Leaders Were Supposed to Eat Last. We Let the Market Eat First.

How AI governance shifted risk downstream while growth and returns were protected upstream.

The public debate around artificial intelligence governance has been framed as a disagreement about innovation versus regulation. That framing suggests confusion, competing values and an unresolved policy puzzle. It is also inaccurate. The divergence between the United States and Europe reflects not uncertainty about risk, but a decision about when costs should be paid and by whom.

Europe chose to pay first.

The United States chose to let the market eat first.

Europe Made Data Protection a Constitutional Right

This divergence begins with how power is treated in law. European governance treats personal data and identity as extensions of the person rather than as neutral inputs into markets. That position is constitutional rather than rhetorical. Article 8 of the Charter of Fundamental Rights of the European Union establishes an independent right to personal data protection, requiring lawful processing, purpose limitation and oversight by independent supervisory authorities.

The General Data Protection Regulation (GDPR) operationalized that right by requiring organizations to justify data processing before it occurs rather than after harm becomes visible. 

This architecture produces friction intentionally. Consent must be explicit, specific and revocable. Purpose must be constrained. Processing without lawful basis is prohibited even if no immediate harm can be demonstrated. The point is not efficiency; the point is prevention. The EU's Artificial Intelligence Act extends this posture into AI governance, treating certain uses as high-risk or incompatible with fundamental rights regardless of technical performance or economic value.

The United States built something else.

America Built Its AI Economy in a Legal Vacuum

American legal culture developed around fear of government power rather than fear of private information power. Speech, markets and innovation were elevated; privacy became fragmented, sector-specific and reactive. Outside a few protected domains (health, children, education) data could be collected, inferred, sold and repurposed unless lawmakers explicitly intervened.

The quiet doctrinal shift that made this possible rarely appears in AI panels or policy decks. In Sorrell v. IMS Health Inc. (2011), the Supreme Court treated restrictions on the sale and use of prescriber-identifying data as content- and speaker-based burdens on speech. Once data flows could be framed as speech-adjacent activity, broad privacy regulation became structurally harder. Regulators could punish abuse after harm occurred, but stopping collection or processing before harm became legally and politically fraught.

Artificial intelligence did not introduce new risk.

Artificial intelligence removed the time buffer that made this posture survivable.

GenAI Moves Faster Than Any Legal System Can Respond

Generative AI collapses the distance between data, identity and action. It scales inference, likeness and decision-making faster than legal or institutional remediation can follow. When identity is processed at speed and volume, "we will fix it later" stops being governance and starts being wishful thinking.

Europe responded by extending existing logic. AI uses were evaluated through a harm-first lens: who could be affected, how and whether that harm could be prevented structurally. Oversight and constraint were treated as prerequisites rather than retrofits.

The United States asked different questions.

  • Will regulation slow innovation?
  • Will global competitors gain advantage?
  • Can companies self-regulate?
  • What would binding constraint do to capital formation, valuation and returns already priced into the market?

That last question was rarely spoken publicly, yet it governed outcomes.

AI Investment Surged Where Enforcement Was Weakest

Global corporate investment in AI reached roughly $252 billion in 2024, with private investment in generative AI alone exceeding $33 billion, flowing fastest where enforceable constraints were weakest. Venture capital reporting in 2025 made the dynamic explicit: returns were tied to speed, scale and early dominance, not governance maturity.

Up-front governance costs money. Identity verification costs money. Purpose limitation costs money. Refusal logic costs money. Smaller datasets cost money. Slower rollout costs money.

Letting the market eat first does the opposite. It front-loads growth, captures data, locks in dependence and pushes the bill downstream.

That is why attempts to impose enforceable limits were met not with technical objections, but with calls for delay. In 2025, industry-backed efforts sought a federal moratorium on state-level AI regulation, framed as a response to regulatory fragmentation and competitiveness concerns. The US Senate ultimately stripped the moratorium after bipartisan and state opposition, voting overwhelmingly against it.

The signal was simple: delay constraints while deployment accelerates.

The Free-Speech Distraction

Complaints about European enforcement almost always arrive wrapped in the language of free speech. The move is familiar. It is also wrong.

European regulators are not policing ideas. They are restricting unlawful processing of human identity, including personal and biometric data, where no lawful basis exists. Calling that censorship is not a legal argument. It is a reframing strategy.

Speech language converts a compliance obligation into a cultural grievance. It shifts attention away from architecture and cost and toward values theater. And it works, because it turns a question about who must pay for safeguards into a fight about freedom. This is where delay is easier to defend and enforcement looks ideological rather than financial.

Europe never accepted that trade. Data processing was never elevated to expressive freedom. It remained what it is: an exercise of power that must justify itself before it operates.

This is why some AI features are not merely discouraged in Europe, they are structurally difficult to ship.

Who Was Actually 'Leading'

Leadership rhetoric celebrates the ethic that leaders eat last — accepting restraint so that others are protected. Under current AI governance, leadership moved upstream. Those setting the tempo were not institutions with duties of care, but capital allocators optimizing time-to-return. Policy influence followed capital rather than stewardship, as lobbying emphasized delay and preemption instead of enforceable safeguards.

Under this construct, leadership meant accelerating scale while externalizing risk.

AI's Tab Came Due — Here's Who Paid It

  • Workers paid it through job churn, deskilling and wage pressure as automation advanced ahead of guardrails
  • Students and patients paid it when AI entered advising, assessment, triage and prioritization without identity-level consent or meaningful refusal
  • Institutions paid it through compliance shock, litigation exposure and reputational damage after adoption
  • Courts and regulators paid it through reactive cleanup, stretching civil-rights and consumer-protection law
  • States paid it fighting preemption while addressing local harms
  • The public paid it through permanent privacy loss once identity data were collected and embedded into models

Who did not pay — at least not first — were early investors and platforms that captured upside during the weakest-constraint window.

The Accounting Conclusion

Europe priced harm prevention into design. The United States priced harm correction into society.

AI governance in the United States did not fail. It was sequenced. Growth first. Constraint later. Returns protected upstream; risk distributed downstream. Leaders spoke about eating last. In practice, AI governance let the market eat first.

The remaining question is not whether that sequence can be defended rhetorically. It is whether institutions, governments and the public are prepared to pay the bill — now that it has arrived.
