FERPA asks one foundational question: Does the system create, maintain or disclose an education record?
If the answer is yes, FERPA applies regardless of whether the record is created by a human, a learning management system or an AI model.
An education record is defined broadly as any record that is directly related to a student and maintained by an educational agency or a party acting for the agency (20 U.S.C. § 1232g; 34 C.F.R. § 99.3). AI does not change this definition. It simply changes the speed and scale at which records are created.

Where AI Fits Comfortably Within FERPA
Many AI tools can be FERPA-compliant when properly governed. These systems typically share several characteristics:
- They are user-invoked, not persistent observers
- They are stateless or retain data only briefly for service delivery
- They do not infer or score student behavior beyond the immediate interaction
- Any outputs that become education records are stored inside the institution’s LMS or SIS, under institutional control

Problems arise when AI systems move from assistance to monitoring, inference and autonomous judgment. These systems do not merely respond to prompts; they observe, analyze and persist information about students over time. At that point, they are no longer neutral tools. They are record-producing infrastructure.
Common high-risk features include:
- Continuous logging of student prompts and responses
- Behavioral inference (e.g., detecting confusion, sentiment, effort or AI use)
- Scoring or rating student “origin,” honesty or engagement
- Cross-role exposure of analytics to faculty, advisors and administrators
- Vendor-controlled retention, analytics or model improvement using student data
These capabilities create education records outside traditional governance pathways and often exceed what institutions can justify under FERPA’s school-official exception.

The Governance Test Institutions Should Apply
Before adopting any AI-enabled technology, institutions should ask:
- Does the system create or infer student-identifiable information?
- Where are those records stored, and for how long?
- Who can access them, and under what authority?
- Can students exercise FERPA rights of access and amendment?
- Can the institution enforce destruction and prevent secondary use?
If these questions cannot be answered clearly, FERPA compliance is already in doubt.
The Line That Matters
The distinction is not between AI and non-AI systems. It is between tools that assist learning and systems that observe and judge students.
FERPA allows the former. It constrains the latter.
Institutions that recognize this difference can adopt AI responsibly and at scale. Those that do not may discover, too late, that innovation does not excuse record-keeping.
